TERMS OF SERVICE
QVault-Assessments Terms of Service

These Terms of Service ("Terms") govern access to and use of QVault-Assessments ("Service").
By using the Service, you agree to these Terms.
1. Eligibility and Authority
- You must be authorized to use the Service (as teacher, student, or institution member).
- If you use the Service on behalf of an institution, you represent that you have authority to bind that institution.
- Students under the legal age of digital consent in their jurisdiction must use the Service under teacher or institutional supervision.
2. Service Use
You agree to use the Service only for lawful educational or assessment-related purposes and in accordance with:
- these Terms
- applicable law
- institutional policies
3. Account and Access Security
Users are responsible for:
- maintaining credential confidentiality
- accurate role / student identity input
- reporting unauthorized access promptly to drdishantpandya@gmail.com
4. Content and Data Responsibility
Teachers and institutions are responsible for:
- quiz content legality and appropriateness
- grading policies and fairness
- identity and participation rules configured in sessions
Users must not upload content that is unlawful, harmful, infringing, or abusive.
5. Proctoring and Integrity Features
The Service may include anti-cheat and integrity controls (for example app-switch tracking, geofence checks, and audit indicators). Institutions and teachers are responsible for lawful and policy-compliant use of such features and for informing students of any active integrity policy.
6. Result Publication and Access
Result visibility is controlled by session policy (immediate, manual, or scheduled). Secure token / result link mechanisms are provided for controlled access and should not be shared publicly.
7. Interoperability
TeachVault and related integrations are optional. When enabled, data exchanges follow configured contracts and user-controlled workflows.
8. Plans, Pricing, and Delivery Model
QVault follows this commercial structure:
- Free Explorer: free access for local workflows plus a limited online demo experience.
- Creator Pro Lifetime: a one-time paid unlock for the full teacher-side builder workflow.
- School / Institution: annual or custom workspace arrangements for collaboration, governance, and larger-scale delivery.
- Live Join Packs: usage-based live delivery for successful new student joins.
- QVault AI Credits: usage-based managed AI and other server-routed cloud actions where applicable.
Important rules:
- Buying Creator Pro Lifetime does NOT promise unlimited live delivery forever.
- Public pricing may present Live Join Packs and QVault AI Credits as secondary add-ons rather than equal base plans.
- Live delivery may require available live join packs or an applicable workspace entitlement.
- Reconnects, resumes, and result checking are not intended to be treated as new paid joins in the launch model.
- TeachVault Pro and QVault commercial layers may be aligned as part of the suite story, but one product does not automatically grant unlimited rights in the other unless expressly stated in a bundle or agreement.
In-app purchases are processed by Apple (App Store) or Google (Play Store). Refunds for in-app purchases are governed by the relevant platform's refund policy. Contact us at drdishantpandya@gmail.com if you need help getting a refund routed through the correct platform.
9. Teacher-Owned Storage and Optional Providers
QVault may support teacher-owned or institution-controlled destinations and providers, including:
- Google Drive (Android) and iCloud Drive (iOS) as the default cloud destinations for encrypted teacher backups in the public Play Store and App Store builds
- TeachVault suite interoperability
- optional third-party AI or Math OCR providers configured by the user
Where these workflows are used:
- the user is responsible for their third-party account, credentials, spending, and compliance choices
- QVault may facilitate the workflow, but does not automatically include bundled third-party credits unless the product explicitly says so
- optional provider or storage terms remain separate from these Terms
The default app does NOT upload teacher backups to QVault's own cloud storage. The encrypted backup payload is uploaded directly from the teacher's device to the teacher's own cloud account. Managed institutional builds may, with the operating workspace's explicit agreement, route snapshots to a workspace-controlled storage destination instead; that variant is shipped under a separate enterprise agreement and notice.
10. Acceptable Educational Use and Fairness
Teachers and institutions must use QVault fairly and responsibly. In particular, users must not:
- use join-code or result-link workflows for abuse, spam, or harassment
- misrepresent student identity or academic records
- use anti-cheat controls unlawfully or outside permitted institutional policy
- attempt to evade plan limits, live-credit metering, or workspace controls through technical abuse
- attempt to reverse engineer, decompile, or extract source code from the app, except where such restriction is prohibited by law
11. Intellectual Property
The Service, software, and associated materials are protected by applicable intellectual property laws. No rights are granted except as needed for permitted use of the Service.
User-created content (quizzes, items, attempts) remains the property of the teacher / institution / student who created it. By using the Service, you grant QVault a limited license to store, transmit, and process that content solely to operate the Service for you.
12. Availability and Changes
The Service may evolve over time with feature changes, fixes, or deprecations. We may modify or discontinue parts of functionality with reasonable notice where feasible.
13. Warranties Disclaimer
The Service is provided on an "as is" and "as available" basis, to the extent permitted by law. No guarantee is made that the Service is uninterrupted or error-free.
14. Limitation of Liability
To the maximum extent permitted by law, liability for indirect, incidental, special, consequential, or punitive damages is excluded.
Nothing in these Terms limits liability that cannot be legally limited.
15. Termination
Access may be suspended or terminated for violations of these Terms, misuse, security risks, or legal requirements. Users may terminate their own account at any time using the account deletion process at https://drdishantpandya.com/qvault/account-deletion.
16. Governing Law and Jurisdiction
Default governing law for this distribution is India, unless superseded by a signed institutional agreement or mandatory local law. Courts in Gandhinagar, Gujarat, India shall have exclusive jurisdiction over disputes, subject to mandatory consumer-law protections in the user's country of residence.
